Licensing, insurance and the law
A law enforcement officer pulls you over. Which documents must you, as the driver, produce?
- Your driver's license, proof of insurance and the vehicle registration. Correct answer
- Your driver's license only; the other two are requested but optional.
- Your driver's license and identification for every passenger in the vehicle.
Why
Three documents, and all three are required of the driver: license, proof of insurance and vehicle registration. Calling them optional does not match what follows in the handbook either, because if a driver does not produce them officers may conduct a limited search for them. Passengers stand in a different position. An officer may request their names or identification and they can decline that request, although under some circumstances they may be required to identify themselves. What is not optional for anyone in the car is position: an officer may lawfully order everyone in the car, driver and passengers alike, to step out or to stay put, and an order either way has to be obeyed. And in California only federal law enforcement officers may ask about immigration status.
